The Seller/Provider and the Buyer shall hereinafter be collectively referred to as the “Parties”.

2. SUBJECT OF THE AGREEMENT

The subject of this Distance Sales Agreement is to determine the rights and obligations of the Parties regarding the sale, delivery, use conditions, right of withdrawal, exceptions to the right of withdrawal, refund conditions, and other terms related to the digital crochet pattern PDF files ordered electronically by the Buyer through the Seller’s website, https://patternyarn.com.

The products subject to this Agreement are digital content products. The purchased product is not a physical item. No printed product, printed pattern, finished crochet item, yarn, hook, accessory, or any other physical product will be shipped.

3. MAIN CHARACTERISTICS OF THE PRODUCT

3.1. The product subject to sale is a digital PDF file containing crochet pattern instructions.

3.2. The product name, main characteristics, sale price, payment details, and any applicable campaign conditions are the information displayed on the website and in the order summary at the time the order is completed.

3.3. Since the product is delivered digitally, there is no physical shipping process.

3.4. The digital PDF files sold by PatternYarn are intended to provide crochet pattern instructions. The final result may vary depending on the Buyer’s skill level, materials used, yarn type, hook size, tension, interpretation of the pattern, and other personal factors.

4. PRICE, CURRENCY, AND PAYMENT

4.1. The total sale price of the product, including all applicable taxes where applicable, is the price displayed on https://patternyarn.com at the time the order is completed.

4.2. Unless otherwise stated on the website, prices are displayed and charged in USD.

4.3. Payment is made using the payment methods offered on the website. Payment infrastructure provided by iyzico payment systems supported by Shopify may be used.

4.4. In order for the order to be processed, the payment must be successfully completed. If the payment is rejected, cancelled, reversed, or charged back by the bank, card issuer, or payment service provider, the Seller shall not be obliged to deliver the product.

4.5. The Buyer is responsible for any bank fees, card fees, exchange rate differences, or international transaction fees that may be charged by the Buyer’s bank, card issuer, or payment provider.

5. DELIVERY

5.1. The purchased digital PDF file will be delivered electronically to the Buyer after payment approval. Delivery may be made through a download link, order page, customer account, order confirmation email, or any similar digital access method provided by the system.

5.2. No physical shipping is carried out for digital products. Therefore, no shipping fee is charged.

5.3. The Buyer is responsible for providing a correct and accessible email address during the order process. If the Buyer provides an incorrect email address, if the email is delivered to the spam/junk folder, or if the Buyer experiences access issues due to their own device, software, internet connection, or similar technical conditions, the Seller will provide reasonable support.

5.4. If the Buyer cannot access the download link, if the link does not work, or if the Buyer experiences a technical issue opening the PDF file, the Buyer may contact info@peoplepark.app with the order number and the email address used during the purchase.

5.5. After receiving the support request, the Seller may resend the file or download link, or provide support to resolve the access issue.

5.6. If delivery of the digital product becomes impossible due to a reason caused by the Seller, the Buyer will be informed in accordance with applicable legislation, and where legally required, a refund will be issued.

6. RIGHT OF WITHDRAWAL

6.1. As a general rule, consumers may have the right to withdraw from distance contracts within 14 days without giving any reason. However, applicable legislation provides certain exceptions to the right of withdrawal for specific goods and services.

6.2. The products sold under this Agreement are digital crochet pattern PDF files, which are classified as digital content / intangible goods delivered instantly in electronic form.

6.3. The Buyer acknowledges and agrees before completing the purchase that the product is digital content, that no physical product will be shipped, that access to the digital file or download link will be provided after payment approval, and that the digital content may be delivered immediately after the order is completed.

6.4. By placing an order, the Buyer expressly consents to the immediate delivery of the digital content before the expiry of any withdrawal period and acknowledges that the right of withdrawal cannot be exercised after the digital content has been delivered or accessed.

6.5. Therefore, after access to the PDF file, download link, or digital content has been provided, the Buyer cannot exercise the right of withdrawal and cannot request cancellation, return, or refund.

6.6. Cancellation requests submitted before access to the digital content is provided will be reviewed according to the technical status of the order. If digital delivery has been completed, cancellation or refund is not possible, except where mandatory consumer protection laws provide otherwise.

7. REFUND AND SUPPORT CONDITIONS

7.1. If the Buyer cannot access the PDF file, if the download link does not work, or if the Buyer experiences a technical download problem, the Seller’s primary obligation is to resend the digital product to the Buyer or to resolve the access problem.

7.2. If the wrong file is delivered, if the file is corrupted, if the file does not match the purchased product, or if there is any defective performance caused by the Seller, the Buyer may request support by contacting info@peoplepark.app.

7.3. Depending on the nature of the issue, the Seller may resend the correct file, resolve the access problem, or take the necessary action in accordance with applicable consumer protection legislation.

7.4. The Buyer’s statutory consumer rights remain reserved.

7.5. A refund will not be issued solely because the Buyer changes their mind, purchases the wrong item, no longer wants the pattern, lacks the required crochet skill level, uses different materials, or does not achieve the expected final result, provided that the digital product has been delivered or accessed and the product is not defective due to a reason caused by the Seller.

8. USE OF DIGITAL CONTENT AND INTELLECTUAL PROPERTY

8.1. The purchased digital crochet pattern PDF file is licensed for the Buyer’s personal use only.

8.2. The PDF file and its content may not be copied, reproduced, shared, sent to third parties, resold in digital or physical form, distributed for commercial purposes, published on any platform, or used without permission.

8.3. All intellectual property rights, including but not limited to designs, texts, photographs, graphics, instructions, diagrams, patterns, and other content included in the products, belong to PatternYarn and/or the relevant rights holders.

8.4. The Buyer agrees to use the digital file only in accordance with the law and this Agreement.

8.5. The purchase of a digital PDF file does not transfer ownership of intellectual property rights to the Buyer. The Buyer only receives a limited, personal, non-exclusive, non-transferable license to use the purchased file for personal purposes.

9. BUYER’S REPRESENTATIONS AND OBLIGATIONS

9.1. The Buyer acknowledges that, before placing the order, they have read and understood the main characteristics of the product, the sale price, currency, payment terms, digital delivery conditions, refund and withdrawal exceptions, and the terms of this Agreement.

9.2. The Buyer acknowledges that the purchased product is a digital PDF crochet pattern file and that no physical product will be shipped.

9.3. The Buyer confirms that the personal information, email address, delivery information, and payment information provided during the purchase process are accurate and complete.

9.4. The Buyer is responsible for ensuring that they have suitable software, hardware, internet access, and a PDF viewer application required to access and use the purchased digital file.

9.5. The Buyer agrees not to reproduce, distribute, resell, publish, or share the purchased digital file in violation of this Agreement or applicable intellectual property laws.

10. SELLER’S REPRESENTATIONS AND OBLIGATIONS

10.1. The Seller is obliged to deliver the digital product electronically in accordance with this Agreement.

10.2. If the Buyer experiences a download or access problem, the Seller will review support requests submitted via info@peoplepark.app within a reasonable period.

10.3. If delivery of the product becomes impossible, or if there is defective performance caused by the Seller, the Seller will act in accordance with applicable consumer protection legislation.

10.4. The Seller is not responsible for access problems caused by incorrect information provided by the Buyer, the Buyer’s email settings, spam filters, device issues, software incompatibility, internet connection problems, or other technical conditions outside the Seller’s control. However, the Seller may provide reasonable support to help resolve such issues.

11. PERSONAL DATA

11.1. The Buyer’s personal data may be processed for the purposes of receiving the order, processing payment, delivering the digital product, providing customer support, issuing invoices, fulfilling legal obligations, and maintaining commercial records.

11.2. Detailed information regarding the processing of personal data is provided in the Privacy Policy and/or Personal Data Protection Notice available on https://patternyarn.com.

12. EVIDENCE AGREEMENT

The Parties agree that the Seller’s electronic records, system records, order records, payment records, email correspondence, website records, and payment infrastructure records may constitute evidence in disputes arising from this Agreement, to the extent permitted by applicable legislation.

13. DISPUTE RESOLUTION

For disputes arising from this Agreement, the competent Consumer Arbitration Committees and Consumer Courts shall have jurisdiction in accordance with applicable consumer protection legislation.

The monetary limits valid for the relevant year shall be taken into account for applications.

14. EFFECTIVE DATE

By placing an order through https://patternyarn.com, the Buyer declares that they have read, understood, and accepted this Distance Sales Agreement, the Delivery and Refund Policy, and the relevant pre-contractual information.

This Agreement enters into force when the Buyer confirms the order electronically.
